The Advocate appearing on behalf of the petitioner submits that the application made by the petitioner before the respondent authorities is for consideration in the case of the petitioner and the same has not yet been considered. Mr. Chatterjee, Advocate appearing on behalf of the State-respondents prays for an accommodation on behalf of Mr. Samrat Sen, Senior Advocate.

I am of the view since the petitioner has a statutory, efficacious, alternative statutory remedy there is no scope of entertaining this petition.

In fact, in view of the extant Rules and Regulations and the provisions contained in the aforesaid 2016 Rules, I am of the view that this petition is not maintainable. There is no scope for even consideration of the representation of the petitioner.

Accordingly, in view of the provisions of the West Bengal Minor Minerals Concession Rules, 2016, WPA No. 18470 of stands dismissed as not being maintainable.

There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
