1. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated without having any incriminating elements against him. It is further submitted that nothing had been seized from the present petitioner.

2. The learned Public Prosecutor produced the Case Diary and invited attention to the statements of witnesses. It is further submitted that investigation is still going on, awaiting for finalization.

3. On perusal of the Case Diary and other materials, it is found that different witnesses named the present petitioner having direct

nexus with the perpetration of crime and dealing with contraband articles.

4. Since investigation is still going on and the allegation is serious in nature, I am not inclined to allow bail and the same stand rejected.

5. Liberty is given to file bail application at appropriate stage when the Trial Court may decide the matter on its own merits without being influenced by this order.

6. Case Diary may be returned to the Public Prosecutor.

7. Accordingly, the instant application stand disposed of.

8. There shall, however, be no order as to costs.

9. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible (Sugato Majumdar, J.)
