Mr. Sakti Pada Jana ........for the petitioner Mr. Suman Dey ........for the State Affidavit of service filed on behalf of the petitioner is taken on record.

Matter relates to appointment of petitioner in the post of Group -D in a Government aided secondary school based on selection process namely 3rd Regional Level Selection Test, 2016, for Non-Teaching Staff (Group -D).

Petitioner by presenting this writ petition has prayed for according approval of appointment for releasing monthly salary in his favour.

Learned advocates representing the petitioner and State respondents have jointly submitted that selection process being 3rd Regional Level Selection Test, 2016, for NonTeaching Staff (Group -D) has been set aside by the Hon'ble Division Bench and the issue is pending before the Hon'ble Supreme Court.

Learned advocate representing State respondents has placed before this Court a memo dated 8th May, 2023 issued by the Secretary, West Bengal Board of Secondary Education wherefrom it appears that in terms of solemn order dated 12th April, 2023 passed by the Hon'ble Supreme Court on Civil Appeal No. 2419 and 2420 of 2023 (Gopinath Bhanja & Ors. Vs. State of West Bengal & Ors.) West Bengal Board of Secondary Education has decided to keep in abeyance orders by which appointment of candidates in Group -D posts in the schools were cancelled. It is further submitted on behalf of the concerned District Inspector of Schools that name of the petitioner does not feature in the list of selected 1911 candidates for the post of non-teaching staff.

It is also submitted on behalf of the concerned District Inspector of Schools that no approval has been granted to the petitioner since petitioner's name did not feature in the list of selected 1911 candidates.

In view of submissions made on behalf of the respondent authorities and taking note of the fact that the issue is pending before the Hon'ble Supreme Court, at present no relief can be granted to the petitioner.

Writ petition stands dismissed, without any order as to costs.

However, this order shall not preclude the petitioner to take steps in accordance with law if situation so arises in future.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
