Mr. Debasish Saha Mr. Sanjoy Ghosh Ms. Sucheta Pal ....for the petitioners This application under Article of the Constitution of India is at the instance of the bank and its authorised officer praying for a direction upon the learned Debts Recovery Tribunal No.II, Kolkata to dispose of the SARFAESI application No.319 of expeditiously.

The learned advocate appearing for the petitioner draws the attention of the Court to an order dated October 6, 2023 passed in W.P.A. No.18861 of 2023 wherein a direction was passed upon the Debts Recovery Tribunal to dispose of the SARFAESI application expeditiously preferably within December 31, 2023. The learned advocate appearing for the petitioner submits that in spite of such direction the SARFAESI application has not yet been disposed of and the next date has been fixed on September 1, 2025.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned

advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned trial judge. In the light of the submission made by the learned advocate for the petitioner CO 3140 of 2025 stands disposed of by requesting the learned Debts Recovery Tribunal No.II, Kolkata to take up the hearing of the SARFAESI application No.319 of 2022 on the next date i.e. on September 1, 2025, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible keeping in mind the direction passed on October 6, 2023 in W.P.A. No.18861 of 2023.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
