It is not in dispute that the principal accused was produced before the learned vacation Judge at Barasat and was released on bail with an observation that the accused had married the victim lady and had lead a marital life together. Since the accused and the victim lady belong to different communities, they married under the Special Marriage Act voluntarily. The order also records that the said marriage was not accepted by the family members of the victim lady. Such observation corroborates the letter signed by the victim lady to the police authority on July 01, 2025. Though the petitioner admits the signature of the victim lady in the letter, he submits that the hand writing in the letter does not belong to her. His allegation shall be dealt with by the appropriate court. Since it prima facie appears that the victim lady has married the accused

and is residing with him and also since the learned trial Court is in seisin of the matter, nothing further remains to be adjudicated in the present writ petition. The same is accordingly disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
