Maiti ... for the petitioners This application under Article of the Constitution of India is at the instance of the decree holders praying for a direction upon the learned Civil Judge (Junior Division), 2nd Court at Paschim Medinipur to dispose of Title Execution No. 4 of 2023 expeditiously. Mr. Das, learned advocate appearing for the petitioners submits that J. Misc. Case 202 of 2024 was filed by the opposite parties under the provisions of Section 47 of the Code of Civil Procedure.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge.

From the ordersheet it appears that J. Misc. Case 202 of 2024 is still pending.

The learned Civil Judge (Junior Division), 2nd Court at Paschim Medinipur is requested to make an endeavour to dispose of J. Misc. Case 202 of 2024, if the same is still pending, as expeditiously as possible without granting any unnecessary adjournment to either of the parties. In the event there is no impediment on the part of the executing court to proceed with the execution case, the learned judge of the executing court shall make an endeavour to proceed with the Title Execution Case No. 4 of 2023 in accordance with law and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

With the above observations, C.O. 3144 of 2025 stands disposed of.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
