Heard the learned advocates appearing for the respective parties. It appears that the petitioner has already suffered incarceration for 305 days and upon completion of investigation charge sheet has been submitted. Upon assessment of the materials in the case diary, it, prima facie, appears that the extent of complicity of the petitioner is similar to that of one Arjun Singha, who had already been enlarged on bail by a Coordinate Bench of this Court. Considering the nature of accusations and the period of detention, we are of the opinion that further detention of the petitioner is not necessary. Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Raiganj, Uttar Dinajpur with a further condition that the petitioner shall attend the learned trial court on all the dates as specified for hearing.

It is further directed that the petitioner shall not intimidate the witnesses or tamper with evidence in any manner whatsoever.

It is made clear that in the event the petitioner fails to comply with the aforesaid directions without any justifiable cause, the learned trial court would be at liberty to cancel his bail without any further reference to this Court.

The application for bail being CRM No.8858 of 2021 is, accordingly, disposed of.
