Heard learned counsels for the parties.

Being the highest bidder in e-auction floated for extraction of sand and upon depositing the entire bid amount alongwith earnest money, Letter of Intent was issued in favour of the petitioner on 5th December, 2018. The petitioner submitted draft lease deed alongwith bank guarantee and requested execution of the deed of lease by a representation submitted before the authority on 1st August, 2022. Such representation has not been considered as yet. The petitioner prays for direction upon the concerned authority to consider the representation at the earliest.

Upon consideration of the submission made on behalf of the parties the writ petition is disposed of directing the 4th respondent to consider and dispose of the

representation submitted by the petitioner dated 1st August, 2022 within one month from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested persons including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereafter. With the above observations and directions, the writ petition being WPA 20323 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
