Learned advocate for the petitioner submits that the petitioner is in custody for 356 days.
There is hardly any material implicating the petitioner in the offence.
Learned advocate for the state submits that wearing apparel of the petitioner containing blood stains was recovered. Two mobiles were recovered on the leading statement of the petitioner. One of such mobile belonged to the victim. There are statements of independent witnesses hearing the petitioner discussing about the killing of the victim.
Considering the gravity of the offence and the involvement of the petitioner therein, we are unable to enlarge the petitioner on bail at this stage. CRM 8859 of 2021 is rejected.
