Petitioner is aggrieved by the fact that in spite of informing the police authorities no steps have been taken and the petitioner till date is unable to enter the property in spite of ad interim order of injunction passed by the learned Civil Judge (Senior Division), Islampur, Uttar Dinajpur in connection with P.S. No. 248/2024. State has submitted a report. Report reflects that a long standing dispute is existing in respect of 16 bighas of land. There are cases and counter cases and chargesheet has also been submitted in connection with the said case.

So far as the petitioner's grievance relating to entering the land is concerned which he complains that he has been resisted at the behest of the private respondents, petitioner would in such circumstances approach the learned Civil Court for specific orders upon the police authorities. In case there are directions upon

the police authorities, they would respect, obey and implement the same.

In the meantime, police authorities would continue their vigil and ensure that there is no breach of the peace and/or tranquility.

With the aforesaid observations WPA 20052 of 2025 is disposed of.

Report submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
