The petitioners' contention is that they were employees working in the head office of respondent no. 2. Following the industrial dispute between the employer and the employees, the bank engaged a new security supervisor in place of the former who was asked to relinquish after the office hours on September 22, 2019. Such decision of the bank authority was challenged by the petitioners and an application to that effect was filed before the Deputy Chief Labour Commissioner (Central), Ministry of Labour, Government of India (Conciliation Officer) on September 11, 2019.

The petitioners' grievance is that such application is still pending before the authority. It is further submittted that the bank has no role to play in the matter and no relief is sought against the bank in the present writ petition.

Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of with a direction upon the respondent no. 3 to consider and dispose of the application of the petitioners dated September 11, 2019 within a period of two months from the date of communication of this order after affording reasonable opportunity of hearing to all the affected parties including the petitioners, in accordance with law.

With the above observations and directions this writ petition being WPA No. 18511 of 2019 is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
