The petitioner complains of alleged inaction on the part of the Kasba Police Station in intervening against the private respondents with regard to disturbance to his tenanted premises. The petitioner wants to conduct repairs thereat.

The private respondents/landlord have submitted that Ejectment Suit No.123 of 2022 has been filed against the petitioner and is pending before the learned Civil Judge (Junior Division), 1st Additional Court, Alipore and an order of status quo dated 17.06.2022 has been passed by the Court below. The petitioner may take appropriate steps in the said suit as the matter is primarily civil in nature. The Kasba Police shall ensure that there is no breach of peace in the area and strictly comply with and enforce any order that may be passed by the Civil Court on them in accordance with law.

With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.

The report in the form of instructions dated 29th January, 2023 issued by the Additional Officer-inCharge, Kasba Police Station, Kolkata addressed to the State Advocate is taken on record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
