Learned advocate appearing for the petitioner is aggrieved by the fact that, in spite of the case being filed in the year 2020, the proceeding under Section 138 of the Negotiable Instruments Act is not progressing with the spirit of the provisions before the learned Judicial Magistrate, Bangaon, North 24 Parganas. Learned advocate has submitted that the next date has been fixed on 30.08.2023 for evidence of PW.1. In case the learned trial court feels that the accused persons have designed a policy of delaying the trial, learned trial court would be at liberty to invoke its jurisdiction under Section 143A of the Negotiable Instruments Act. All efforts be taken by the learned trial court so that the trial is concluded at the earliest and for the said purpose the learned trial court would fix at least one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, CRR 3087 of 2023 is disposed of.
Pending application, if any, is consequently disposed of.
