1. During the course of submissions learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file appropriate proceeding.

2. In view of the submissions made, the petition is dismissed as withdrawn with liberty to file appropriate proceeding in accordance with Employees State Insurance Act. The question of limitation in filing the appeal under Section 82 of the ESI Act shall be considered and decided by the Court taking into account the fact that the present petition was filed.
