1. Affidavit of service filed in Court today is taken on record.

2. Instruction forwarded by the Officer-in-Charge, Coke Oven Police Station signed on 1st September, 2025 filed in Court today be retained with the records.

3. The petitioner has raised certain allegation against the illegal performance of Durga Puja by the members of the Sagarbhanga LIG Public Rental Housing Estate at Durgapur.

4. An objection was filed by the petitioner before the District Magistrate & Collector on 30th June, 2025. The same was forwarded by the District Magistrate to the Sub Divisional Officer, Durgapur.

5. The petitioner alleges that the same has not been disposed of till date.

6. There is nothing on record to suggest that the Sub Divisional Officer considered the complaint of the petitioner which was forwarded by the District Magistrate & Collector.

7. Learned advocate representing the respondent nos. 12,14 &17 submits, upon instruction that, the Puja is being performed for nearly fifty eight years with the necessary permissions from all competent authorities.

8. Learned advocate representing WBSEDCL submits, upon instruction that, the electricity connection was provided to the Puja for the last seven years upon payment of necessary charges.

9. Without entering into the merits of the claim of the petitioner, as it appears that the complaint of the petitioner is pending consideration at the end of the Sub Divisional Officer, accordingly, the instant writ petition is disposed of by directing the Sub Divisional Officer, Durgapur being the respondent no. 10 herein to consider and dispose of the objection of the petitioner strictly in accordance with law after giving reasonable opportunity of hearing to all the necessary parties at the earliest but positively within a period of eight weeks from the date of communication of this order.

10. A reasoned order shall be passed by the aforesaid respondent and communicated to the parties immediately thereafter.

11. It will be open for all the parties to rely upon all the documents in support of their respective claim at the time of hearing.

12. The writ petition stands disposed of.

13. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
