This writ petition has been filed by the petitioners on the alleged inaction on the part of the respondent Electricity authority in not removing and discontinuing the electric meter being No. 5794422 installed at the premises of the petitioners being premises No. T/8/C Rahim Ostagar Road, Lake Police Station, Kolkata - 700045 by claiming to be the owner of the said premises in question.
Learned advocate appearing for the private respondent highly disputes such claim of the petitioners by contending that the petitioners are not exclusive owner of the premises in question.
Considering the facts and circumstances of this case and submission o the parties this writ petition being WPA 20301 of 2023 is disposed of by directing the Electricity authority concerned to take final decision on the prayer of the petitioners made in this writ petition by passing a reasoned and speaking order after giving opportunity of hearing to the petitioners and the private respondent or their authorised representatives and by allowing both the parties to submit sufficient documents in support of their claim. If it is found that petitioners have been able to make out a case in their favour in that event respondent electricity authority shall take immediate steps for redressal of the grievances of the petitioners.
It is clarified that the hearing will be done by Grievance Redressal Officer concerned.
