Abdul Muchha Mahatpure @ Abdul Mosa Mahatpure versus The State of West Bengal & Ors.

Mr. Suman Ghosh, Mr. Gaurab Das ... For the State.

Petitioner approached this Court being aggrieved by inaction of the police authorities wherein the accusations were against the private respondent nos. 4 and 5 and their associates for disturbing the peaceful possession of the petitioner in respect of enjoying his property/land.

State has submitted a report which reflects that the police authorities at the relevant point of time have taken appropriate steps and number of criminal cases have been registered.

Having regard to the passage of time and the steps taken by the police authorities, I am of the view that presently no direction is required to be passed upon the police authorities. However, if the petitioner is faced with inconveniences, he would approach the police authorities who would take steps in accordance with law.

With the aforesaid observations, the writ petition being WPA 20626 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
