Inspection report bearing no. 2262/A.E./Bldg/2223 dated December 21, 2022 signed by the Assistant Engineer, In-Charge of Building Department countersigned by the Sub-Assistant Engineer, Howrah Municipal Corporation is taken on record. Copy of the same has been handed over to the learned advocate representing the petitioner.
It appears therefrom that there has been massive unauthorized construction. The same is required to be dealt with by the Howrah Municipal Corporation. In view of the above, the present writ petition stands disposed of directing the Howrah Municipal Corporation to take steps against such unauthorized construction in accordance with law, at the earliest after giving reasonable opportunity of hearing to all the necessary parties.
The proceeding shall be concluded within a period of eight weeks from the date of communication of a copy of this order.
In the event, the private respondents who are responsible for raising unauthorized construction are not available, then the notice of hearing shall be affixed at conspicuous places at the site of the unauthorized construction.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
