Perused the police report. The same is taken on record.
It appears that the police authorities have initiated Electronics Complex PS Case No. 125/2019 dated November 23, 2019, under Sections 420/406/467/120B/34 of the Indian Penal Code. It also appears that the police authorities have taken some steps with regard to the progress of the investigation. It is stated that the seizure of the gold, shall be done in due course. The Investigating Officer has been changed after transfer of the earlier one. The petitioner was also asked to file necessary documents.
This court is of the view that the Officer-inCharge, Electronic Complex Police Station shall personally investigate into the matter under the
direct supervision of the Commissioner of Police, Bidhannagar Police Commissionerate.
The Economic Offence Wing, CID, West Bengal had also called the petitioner for an enquiry in the matter. The police authorities and the Economic Offence Wing, CID, West Bengal shall coordinate with each other and conclude the investigation under the supervision of the Commissioner of Police, Bidhannagar Police Commissionerate, expeditiously. It goes without saying, that immediate steps should be taken to interrogate the bank officials, the gold appraisers, the loanees and any other person who may in the, prima facie, opinion of the police authorities, be connected with such transaction. It is expected that the investigation is concluded preferably within a period of three months from the date of communication of this order, as already a lot of time has been lost during the pandemic period.
The writ petition is disposed of.
There shall be no order as to costs.
