Learned advocate appearing for the petitioner has 03.09.2025 Court No. 35 D/L. No.35 Rakib preferred the writ petition praying for completion of investigation arising out of Thakurpukur Police Station case no. 211 dated 25.07.2023.

State has submitted a report. Report reflects that the police authorities on conclusion of investigation vide Challan No. 49/2025 filed a Final Report before the learned A.C.J.M., Alipore declaring the case to be civil in nature.

Be that as it may, since police authorities had already concluded the investigation, petitioner should be notified regarding the outcome of the investigation. Petitioner, if she is aggrieved regarding the finding of the police authorities, she would be at liberty to take out an appropriate application under the relevant provisions of Section 173(8) of the Cr.P.C. Learned Magistrate in such case would at the earliest dispose of the application after

assessing and ascertaining regarding the contents of the same.

With the aforesaid observations WPA 20040 of 2025 disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
