It is not in dispute that pursuant to the complaint of the petitioner dated June 27, 2024 FIR being Thanarpara Police Station Case No.183 dated 04.07.24 under Section 34/406/420 of the Indian Penal Code has been registered. Learned advocate appearing for the State files a report of the Inspector-in-charge of the said Police Station dated August 31, 2024.

It appears from the said report that the concerned I. O. requisitioned the documents pertaining to the record of rights in respect of the plots which is the subject matter of dispute in this writ petition. It further appears that the Investigating Officer submitted a requisition to the concerned Additional District Sub-Registrar, Karimpur to verify the authenticity and genuineness of the deeds in question. The FIR named accused person obtained bail from the concerned Additional Chief Judicial Magistrat, Tehatta Court on July 25, 2024. From the report of the

Inspector in charge of the concerned Police Station it appears that the police have taken steps after registration of the FIR and the investigation is in progress. Learned advocate for the private respondents submits that the allegation levelled against the private respondents is without any basis.

Considering the nature of the dispute involved between the parties, this writ petition stands disposed of by directing the concerned I. O. to conclude the investigation and take all consequential steps at the earliest.
