Mr. Ekramul Bari Ms. Tanuja Basak ....for the petitioner. Mr. Rajaram Banerjee ....for the State. The writ petition has been filed by a retired assistant teacher claiming fixation of pension and other retiral benefits considering the last pay drawn by the petitioner @ Rs. 11725/- not @ Rs. 11125/- and it has been submitted on behalf of the petitioner calculation of pension taking into account last pay of the petitioner at Rs. 11125/- is erroneous.

Matter has been heard by this Court on number of occasions in presence of the learned advocates representing the petitioner and the State respondents.

Court was considering the entitlement of the petitioner to receive retiral dues including pension based on last pay drawn by the petitioner i.e. Rs. 11725/-.

Mr. Bari, learned advocate representing the petitioner submits on instructions that petitioner is not pressing this prayer.

Accordingly, writ petition stands dismissed as not pressed in view of aforesaid submission being made on behalf of the petitioner.

However, in terms of one of the orders passed by this Court previously District Inspector of Schools (SE), Howrah, has filed certain documents which are annexed to the letter dated 17th November, 2022 addressed to the learned advocate representing the State respondents.

According to the learned advocate for the petitioner there are certain anomalies which are apparent in those documents annexed to the letter dated 17th November, 2022 relating to the service of the petitioner. Petitioner has prayed for leave to question those documents, if necessary.

Leave is granted to the petitioner to take appropriate steps, if so advised, in accordance with law, questioning the contents of the documents as annexed to the aforesaid letter dated 17th

November, 2022.

However, there shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
