Mr. Ranojoy Chatterjee Mr. Tamal Singha Roy .....For the Petitioner Mr. Jayanta Samanta Mr. Keshab Chandra Das .....For the State The petitioner alleges that no steps have been taken by the police authorities excepting registration of an First Information Report.
It appears that pursuant to a complaint lodged by the petitioner on November 9, 2023 and FIR being No. 523 dated 21.11.23 under Section 419/420/120B of the Indian Penal Code has been registered.
Learned advocate appearing for the State files a report of the Inspector-in-charge, Mandir Bazar Police Station dated September 23, 2023, which is taken on record.
From the said report it appears that statements of the available witnesses have been recorded under Section 161 of the Code of Criminal Procedure. The I. O. has sent a notice under Section 91 of the Criminal Procedure Code to the petitioner for production of all relevant documents as per his allegation and the same was received by the father of the petitioner. The report further records that a notice under Section 41(A of the Code of Criminal Procedure was also served upon the FIR named accused person on July 3, 2024. The FIR named accused, namely, the private respondent no.3 herein surrendered before the Learned Additional Chief Judicial Magistrate,
Diamond Harbour on 2nd July, 2024 and the Learned Additional Chief Judicial Magistrate granted bail to the said FIR named accused on that date. It appears that the police authorities have taken some steps on the basis of registration of the FIR.
Learned advocate for the respondent submits that at least four months time is necessary to conclude the investigation.
On the basis of the said submission, the writ petition stands disposed of by directing the concerned I. O. to conclude the investigation and take all consequential steps at the earliest.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
