Affidavit of service filed on behalf of the petitioner is taken on record.

Petitioner made an application for transfer on portal on 23rd March, 2022 since wife of the petitioner was suffering from gynecological disorder. Since wife of the petitioner was medically examined in 2022 it is submitted by learned advocate representing the petitioner that she is willing to be examined medically again to ascertain her present health condition.

Respondent authorities are represented by learned advocates who have submitted that three years have passed after submitting transfer application by the petitioner on 23rd March, 2022 and by this time health condition of wife of the

petitioner may have improved due to constant care and treatment.

Having considered the submissions made on behalf of the parties, the District Inspector of Schools (SE), Bankura being respondent no. 5 is directed to obtain report on medical examination of wife of the petitioner from concerned Chief Medical Officer of Health/ Medical Board by four weeks from date of communication of this order. In the medical report concerned Chief Medical Officer of Health/ Medical Board is required to opine considering present health condition of wife of the petitioner whether she requires constant care and treatment or not. If medical report justifies transfer of the petitioner, transfer application along with medical report shall be forwarded to the Secretary of the West Bengal Central School Service Commission (for short, "Commission") by fortnight thereafter. On receipt of transfer application and medical report, the Secretary of the Commission shall decide the same in accordance with law by four weeks thereafter. Decision to be taken by the Secretary of the Commission shall be communicated to the petitioner by fortnight thereafter.

Leave is granted to the petitioner to amend the cause-title of the writ petition and add

Secretary of the Commission as additional respondent in course of this day. However, service of notice upon additional respondent is dispensed with since the Commission is represented by learned advocate.

However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.

Writ petition stands disposed of.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
