....For the Petitioner Learned advocate appearing on behalf of the petitioner submits that the learned Additional District Judge, 2nd Court, Serampore, Hooghly passed an order dated 30th January, 2021 staying the decree passed in T.S. No. 268 of 2013 (3474/2014) without considering the petition under Section 5 of the Limitation Act and being aggrieved, this revisional application under Article 227 of the Constitution of India was filed before this Court. It is further submitted that on 12th May, 2022, the learned Additional District Judge, 2nd Court, Serampore, Hooghly passed the order dismissing both the petitions under Section 5 of the Limitation Act as well as the appeal itself.

Accordingly, the instant revisional application has become infructuous.

After perusal of the order under appeal dated 12th May, 2022, I also do not find any reason to continue with this revisional application which has become infructuous right now.

This being the position, the instant application being C.O. 2276 of 2021 stands disposed of.
