Report filed on behalf of the State is taken on record. A copy of the same is handed over to the learned counsel for the petitioner.

Learned counsel appearing on behalf of the private respondents submits that the private respondents do not want to proceed with the complaint against the petitioner lodged before the Survey Park Police Station. Accordingly, she has given a letter to the concerned police authorities. Learned counsel appearing on behalf of the State relies on the report and submits that in the changed circumstances the Investigating Agency wants to draw up a fresh challan and submit a report in final form as "Not Charge-sheeted for want of evidence" and to submit the same before the learned Additional Chief Judicial Magistrate, Alipore South 24-Parganas.

As the complainant has withdrawn her allegations in the said matter and the Investigating Agency is willing to file a report in final form as "Not Charge-sheeted for want of evidence", no further order need be passed in this regard. However, leave is granted to file an appropriate report in final form.

The Investigating Officer of the case is present in Court with the case diary. His presence is noted and dispensed with. With these observations, the writ petition is disposed of.
