The grievance of the writ petitioner is that he being the lease holder of the leased out plot being Plot No./ No.s 705(P) & Ors.; Sand Block - AD; Area - 6.50 acres of Mouza - Srirampur, J.L. No. 80, under P.S. - Bardhaman; Dist. - Purba Bardhaman for quarry of sand has not been given possession of the said plot of land despite issuance of memo dated 25.05.2022 by the respondent no. 5/authority addressed to the respondent no. 6/authority, a copy of which has been annexed at Page No. 86 of the instant writ petition.

Mr. Mahata, learned AGP appearing on behalf of the respondent/State submits a report and the same is taken on record.

Mr. Mahata in his usual fairness submits before this Court that the respondent no. 6/authority may be directed to handover the possession of the aforementioned plot to the writ petitioner at the earliest.

In view of such, this Court while disposing the instant writ petition directs the respondent no. 6/authority to give delivery of possession to the writ petitioner positively on 27.10.2025 when the writ petitioner will go to the office of the respondent no. 6/authority at 12 O'clock noon.

Such delivery of possession shall have to be given mandatorily on the day and hour as mentioned above by executing necessary documents in favour of the writ petitioner.

Liberty is given to the learned advocate on record for the writ petitioner to communicate the server copy of this order to the respondent no. 6/authority.

Mr. Mahata, learned AGP is also requested to communicate the server copy of this order to the respondent no. 6/authority.

Before parting with, it is made clear that on and from the day and hour of the delivery of possession of the leasehold land, the period of lease for five years will be counted.

With the aforementioned observations, the instant writ petition being WPA 20081 of 2025 is disposed of.

10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
