Mr. Gopal Chandra Ghosh Mr. Rajkrishna Mondal ... for the petitioner Mr. Supriyo Roychoudhury ... for the Municipality The petitioner has alleged that the Barasat Municipality and its Chairman had forcefully put a padlock on the premises of the petitioner, situated at holding No.12, Jessore Road within Ward No.24 of Barasat Municipality.

It is submitted by Mr. Roychoudhury, learned Advocate appearing on behalf of the Barasat Municipality, that the allegations are baseless and the municipal authorities have never put any padlock on the premises in question. It is submitted that the municipal authorities do not have any interest in the property in question.

In view of the submissions of Mr. Roychoudhury, nothing further remains to be decided in this writ petition.

The writ petition is accordingly, disposed of. As no affidavit has been called for, the allegations made against the municipal authorities are deemed to be denied.

However, this order shall not be construed as a decision of the Court with regard to the right, title and interest of the petitioner in respect of the property in question.

There will be no order as to costs.
