The grievance of the petitioner is that the petitioner duly applied for a new electricity connection in her own name at the premises, where her husband is a tenant, but such connection could not be given or any inspection be held to ascertain the feasibility thereof by the CESC Limited due to resistance of the private respondent no.5 and her men and agents. Such stand is corroborated by learned counsel for the CESC Limited as well.
Thus, WPA No. 20372 of 2022 is disposed of by directing the CESC Limited to hold an inspection upon prior notice to the petitioner and the private respondent no.5 to ascertain whether it is feasible to
give a new electricity connection to the petitioner at the premises. Upon such inspection, in the event the CESC Limited is of the opinion that it is technically feasible for such connection to be given, the CESC Limited shall immediately raise a quotation and, upon compliance of all formalities, the CESC Limited shall give such connection to the petitioner at the said premises, preferably within three weeks from the date of compliance of all formalities.
In the event the CESC personnel are obstructed in any manner either in holding the inspection or in giving the connection, the CESC personnel shall be at liberty to approach the respondent no.4, the Inspector-in-Charge, Golabari Police Station for police assistance in that regard. If so approached, the Inspector-in-Charge shall act on the server copy of this order and grant such assistance to the CESC personnel at the cost of the petitioner.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
