Learned counsel for the petitioners argues that, despite being one of the co-sharers of a plot of land, no compensation was paid to the petitioners by the Power Grid Corporation of India while installing a tower on the land of the petitioners.
Such stand is controverted by the Power Grid Corporation.
Learned counsel appearing for the respondent nos.4 to 6 contends that compensation has already been paid to the persons who had approached the Power Grid Corporation with due claims and over whose land the
tower is being installed, to the best of the instructions of the Power Grid Corporation.
However, since the petitioners have also claimed cosharership in the land where the tower is being erected on the basis of certain prima facie documents, WPA 21055 of 2021 is disposed of by directing respondent nos.4 to 6 to consider the representation of the petitioners, annexed at page-34 (Annexure P-3) of the present writ petition, and to decide on the same upon giving an opportunity to the petitioners to produce relevant documents and to be heard, upon prior notice, positively within eight weeks from date.
The respondent nos. 4 to 6 shall, at the earliest thereafter, communicate the outcome of such consideration to the petitioners.
Since I have not called for affidavits in the matter, it is deemed that the respondents do not admit any of the allegations made in the writ petition.
There will be no order as to costs.
Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
