The petitioner alleges that the private respondent has been digging earth from her land by using a JCB machine and holding pisciculture therein. Complaint lodged by the petitioner before the police authority in this regard has not been acted upon.
Learned counsel for the State submits that upon receipt of the complaint from the petitioner the mobile number of the petitioner was collected and she was requested to go to the police station for cooperating in investigation.
The petitioner has not cooperated in investigation.
Be that as it may, since the petitioner alleges that complaint lodged by her has not been acted upon by the police authority, she is at liberty to approach the appropriate forum for redressal of her grievance.
In the meantime, the police authority shall keep strict vigil over the area in order to avoid any untoward incident and to maintain peace and tranquility. The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
