The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioners in connection with Liluah P.S. Case No. 154 of 2021 dated 07.5.2021 under Section 376(2)(1) of the Indian Penal Code, 1860 and Sections 4 and 6 of the POCSO Act, 2012. Heard the learned advocates appearing for the respective parties and considered the materials in the case diary.

Considering the seriousness of offence and as there had been no substantial change in the circumstances of the case subsequent to rejection of petitioner's earlier prayer for bail on January 3, 2022, we are not inclined to exercise any discretion in favour of the petitioner and as such, his prayer for bail is refused at this stage.

Accordingly, the application for bail, being CRM No.8894 of 2021 is dismissed.
