APP Ms. Puspita Saha ... for the State-respondent(s) The petitioner submits that the subject-matter of the present case relates to recovery of 62 Nos. of MK DYL and 39 bottles of unrecognized cough syrup.

Learned advocate also submits that the petitioner is in custody for six months and he has been implicated in connection with the instant case on the basis of statement of a co-accused and added that there has been no recovery from the present petitioner.

Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of the present petitioner. Learned advocate again submits that there are call detail records wherein continuous communications were being sent between the petitioner and

the principal accused. Further, one of the accused persons is absconding.

Having regard to the aforesaid, I am not inclined to enlarge the petitioner on bail, at this stage. Hence, the prayer for bail of the petitioner is Rejected.

However, the learned trial court is directed to split up the trial of the case; complete the process of supply of copies and overcome the stage of consideration of charges, thereafter, release the petitioner on bail on such terms and conditions as it deems fit and proper to ensure presence of the petitioner in court during the trial.

Liberty is granted to the learned advocate for the State to communicate this order to the learned trial court. Accordingly, CRM (NDPS) of is dismissed.
