In this public interest petition the petitioner has made allegation against the private respondent no.14 that he is conducting illegal business of processing of marble blocks brought from Rajasthan and other States after clearing the forest land adjacent to Indo-Nepal border near Bagdogra.
It has been pointed out that the petitioner has already filed representation dated 17.11.2021 before the respondent no.8 i.e. Divisional Forest Officer, Kurseong. The issues which the petitioner is raising require factual enquiry which can more appropriately be done by the respondent no.8.
Learned counsel for the State has fairly submitted
that there is no objection in considering and deciding the petitioner's representation.
Hence, we dispose of the present petition at this stage by directing the respondent no.8 to duly consider the petitioner's representation dated 17.11.2021 in accordance with law after giving an opportunity of hearing to all the concerned parties and after carrying out the spot inspection, if required.
Let this exercise be completed within a period of three months from the date of receipt of a copy of this order.
The petition is accordingly disposed of.
