The petitioner has filed the present application being CAN 1 of 2025 praying for recalling of the order dated 01.07.2025 wherein this Court has dismissed the writ application for default on the ground that none appeared on behalf of the petitioner when the matter was called.

2. Learned counsel for the petitioner submits that the petitioner was arguing the matter in another Court due to which the petitioner could not appear before this Court at the time of call. Accordingly the writ petition was dismissed.

3. Immediately, when the petitioner came to know the writ petition is dismissed on 01.07.2025, on 10.07.2025 the petitioner has filed the present application for recalling of the order.

4. Heard the learned counsel for the petitioner.

5. This Court finds that the petitioner has shown sufficient cause for none appearance of the petitioner when the matter is called.

6. Accordingly, the order dated 01.07.2025 is recalled.

7. WPA 20678 of 2024 is restored in its original file.

8. CAN 1 of 2025 is disposed of.

9. The writ petition is also taken up for hearing.

The grievance of the petitioner in the writ petition on 17.10.2023 the petitioner has made an application under Right to Information Act to the State Public Information Officer seeking some information. In spite of receipt of the said application the State Public Information Officer neither supplied the information to the petitioner nor rejected the same. Accordingly, the petitioner has preferred an appeal before the Appellate Authority on 09.04.2024 but even the Appellate Authority has not considered the appeal filed by the petitioner.

Accordingly, the petitioner has filed the present writ application.

11. Considered the above, this Court finds that no purpose would be served by keeping the writ petition pending.

12. The writ petition is disposed of by directing the respondent no. 4 i.e. the State Public Information Officer, Public Service Commission, Government of West Bengal to consider the application filed by the petitioner on 17.10.2023 and to dispose of the same within a period of four weeks from the date of receipt of this order.

13. WPA 20678 of 2024 is disposed of.

14. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
