Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner has informed the local police station against the private respondents, apprehending that his property would be grabbed. To that effect, the grievance of the petitioner is that no steps were taken by the police authorities. Petitioner has also drawn the attention of the Court to the earlier order dated 23.11.2022 passed in WPA 11268 of 2020 wherein this Hon'ble Court was pleased to record that the Officer-in-Charge, Namkhana Police Station would maintain strict vigil and ensure that there is no breach of the peace in the area.

Learned advocate appearing for the respondent no.4 claims to be in possession of the property.

State has submitted a report wherefrom it reflects that already a proceeding has been drawn up under Section 126 of the BNSS.

In view of the earlier directions passed by the co-ordinate Bench wherein it was also observed that the remedy of the petitioner is before the civil court, I am of the opinion that the police authorities would oversee that no breach of the peace takes place and as such continues their surveillance.

With the aforesaid observations, WPA 19934 of 2025 is disposed of.

There will be no order as to costs.

Report submitted be kept with the record.

Copy of the report be handed over to parties. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
