Petitioner is aggrieved that pursuant to the earlier directions so passed in WPA 15415 of 2024, the petitioner is faced with inconvenience as the petitioner alleges that the private respondents had entered into the property of the petitioner and has started cultivating. Such information was furnished with the police authorities on or about 14.08.2025 but no steps have been taken.

Learned advocate appearing for the State has submitted a report. Report reflects that earlier a criminal case was registered being Namkhana P.S. Case No.09 of 2024 dated 17.01.2024 which has already ended in charge-sheet. Police authorities on

or about 15.08.2025 has already drawn up proceedings under Section 126 of the BNSS.

In case the petitioner is faced with inconveniences, petitioner has already an option to approach the jurisdictional Magistrate as the same set of accused persons are creating disturbance and/or allegedly encroaching upon the property of the petitioner. To that effect, if any application is filed before the jurisdictional Magistrate in seisin of Namkhana P.S. Case No.09 of 2024, relevant orders be passed for modifying the order of bail granted to the accused persons.

Police authorities have already drawn up proceedings under Section of the BNSS.

Accordingly, if the situation is blown out of the proportion, police authorities would advance prayer for imposing stringent condition on the bond to be furnished for keeping peace and tranquility in the area.

With the aforesaid observations, WPA 19940 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
