Mr. Bhaskar Prasad Vaisya, learned Additional Government Pleader appears for the alleged contemnors files a compliance report by way of affidavit by the alleged contemnor no.3(A), affirmed on January 13, 2025, the same is taken on record. Copy has been made over to the learned advocate-on-record for the petitioners. A relevant portion from the report, inter alia, is quoted below:- "This deponent states that in compliance of the aforesaid order dated May 2, 2024 approval had been granted to all the writ petitioners including the third writ petitioner, Sri Surajit Bhattacharjee. Arrear salary had also been disbursed to each writ petitioner and the current salaries are also being deposited each month accordingly.
Unfortunately, on December 18, 2024 while
correcting the designation of the writ petition no.1, in terms of a subsequent order dated December 13, 2024 passed by Hon'ble Justice Aniruddha Roy, the erstwhile District Inspector of Schools (Secondary Education), Nadia had stated that such compliance was being done subject to result of appeal to be filed, if any. This deponent humbly states that the said statement regarding filing of an appeal was made inadvertently and this deponent tenders unconditional apology for the same."
The direction of this Court in the order dated May 2, 2024 wherefrom this contempt proceeding arose is quoted below:- "In view of the foregoing discussions and reasons the service of the petitioners, except the third writ petition, Sri Surajit Bhattacharjee, stand approved with effect from the date of the recognition of school i.e. December 20, 2002. The petitioners except the third writ petitioner, Sri Surajit Bhattacharjee shall get the notional benefit as approved teachers from the date of recognition of the school, i.e. December 20, 2002 and shall get the actual monetary benefit on and from May 1, 2024 and shall continue with the same throughout their rest of the employment career with all consequential benefits."
On perusal of the direction of this Court and the compliance report filed today, it appears that the order dated May 2, 2024 stands complied with. The approval letter dated September 19, 2024 corrected subsequently on dated December 18, 2024 have already been made over to the petitioners. There cannot be any further charge in this contempt proceeding.
Inasmuch as from the statements pleaded by the alleged contemnor in the compliance report stated above, this Court is satisfied that the alleged contemnor has tendered his due apology before this Court for making the unnecessary statements. Such apology is accepted. In view of the above, nothing further survives in this contempt proceeding.
Accordingly, CPAN 1356 of 2024 stands dropped and closed.
The application, CPAN 1356 of 2024 stands disposed of, without any order as to costs.
