A direction to secure expeditious disposal of a Mat Suit No. 31 of 2017 pending before the learned Additional District Judge, 11th Court, Alipore, is the ultimate relief sought for in this case.
As per submission disclosed by the petitioner, there is a Misc Case being No. 675 of 2017 pending before the Court below filed at the instance of the opposite party/wife, praying for alimony pendente lite. It is also submitted that a withdrawal application is also there, filed at the instance of the opposite party/wife regarding the alimony pendente lite.
The only contention thus expressed by the petitioner/husband is against the delay caused in the disposal of the suit.
No other point is raised requiring address by this Court.
In view of the nature of the order proposed to be made in the case, no prior notice is considered to be necessary.
Service upon the opposite party is thus
dispensed with.
Accordingly, learned Additional District Judge, 11th Court, Alipore is requested to ensure expeditious disposal of Mat Suit No. 31 of 2017, after causing disposal of Misc Case No. 675 of 2017, praying for alimony pendente lite or any other interlocutory application, if there be any pending, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable. While endeavouring such exercise, the prayer for alimony pendente lite may be disposed of expeditiously as possible preferably before the second week of March, 2023.
The logical conclusion of the suit may thereafter be reached in terms of the direction mentioned hereinabove.
Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party.
Nothing, however, would prevent the Court below to permit the opposite party to withdraw the application praying for alimony pendente lite, if the opposite party so chooses to do in the meantime. With this observation and direction, the revisional application stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
