CAN 1 of 2023 is an application for restoration of WPA 18865 of 2013 after recalling the order dated 2nd August, 2023 by virtue of which this Court dismissed the writ petition for default.

The application is taken up for hearing in presence of the learned Advocate for the petitioner.

I have heard the learned Advocate for the petitioner. Since the instant application is filed within the statutory period of time and it is stated on behalf of the petitioner that the petitioner could not attend the hearing of the writ petition on 2nd August, 2023 due to his engagement in another court, the instant application is allowed.

The order of dismissal of the writ petition for default is recalled.

The writ petition be restored to its file.
