In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

Learned advocate appearing for the petitioner submits that the application under Section 8 with Section 5 of the 1996 Act is pending for a long time. From the order-sheets appended to this application this court finds that on July 15, 2025, the application under Section 8 read with Section 5 of the 1996 Act was filed.

Learned advocate appearing for the petitioner submits that December 3, 2025 has been fixed for hearing of the application under Section 8 read with Section 5 of the 1996 Act.

In the light of the submission made by the learned advocate appearing for the petitioner, CO 3156 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division) 1st Court at Barasat to take up the application under Section 8 read with Section 5 of the Arbitration and Conciliation Act, 1996 on the next date if the same are otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
