Learned advocate for the State submits a status report of Nalhati case no. 135/03 from which it appears that the trial before the learned Judicial Magistrate, 2nd Court, Rampurhat, Birbhum is going on. 5 PWs have already been examined and 16th January, 2025 is fixed for the evidence of other witnesses. It also appears therefrom that one Asit Das has expired on 3rd December, 2021. 2.

Opposite Parties 2 to 4 are not represented.

However, Learned advocate for the petitioner submits a written instruction of the petitioner, Kalpana Nandi, wherein she has expressed her intention to not to proceed with the matter.

Let this matter dismissed for non-prosecution.

Accordingly, CRR 2680 of 2017 along with CRAN 1 of 2017 (Old CRAN 5538/2017) are disposed of. There will be no order as to costs.
