The genesis of the dispute to the petitioner with the private respondents is a second marriage contracted by him. The private respondents are the relatives of the first wife.

It is alleged that the petitioner was kidnapped while he was on his way to the Office of the Block Land & Land Reforms Officer and made to sign on blank papers.

It appears from the record that the police have investigated into the matter and found that the allegations are substantiated. It further appears that there has been a settlement between the petitioner and his first wife. This is denied by the Counsel for the petitioner.

In the backdrop of the above, this Court is of the view that the petitioner may approach the jurisdictional Magistrate under Section 156(3) of the Code of Criminal Procedure in accordance with law.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
