Mr. Sukanta Das ... for the petitioner Ms. Jhuma Chakraborty Mr. Parikshit Goswami ... for the State Affidavit of service filed in Court is taken on record. It appears that the private respondent could not be served with a notice.

A report filed by the State is also taken on record. Learned advocate for the petitioner alleges police inaction in not registering an FIR on the complaint of the petitioner.

Learned counsel for the State relies on the report and submits as follows. An FIR has already been registered in this regard being New Town Police Station Case No.265/23 dated 25.08.2023 under Sections 342/328/417/376(n)/506 of the Penal Code.

Arrangements have been made for medical examination of the victim and recording her statement under Section 164 of the Code.

As the prime grievance of the petitioner of nonregistration of FIR has already been redressed, no further order need be passed in this regard.

However, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. As affidavits were not called for, the allegations made are deemed not to have been admitted.

With these observations, the writ petition is disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
