The petitioner is in custody for more than 200 days and prays for bail.

Learned counsel for the petitioner submits that the petitioner is similarly circumstanced with the co-accused who has been granted bail earlier.

Learned counsel for the State opposes the prayer. The petitioner does not appear to be the principal assailant though the offending weapon has been recovered at the instance of the petitioner and the principal assailant. He along with the coaccused were the members of the gang which attacked and assaulted the victim.

In view of the fact that the petitioner is similarly circumstanced with the co-accused who has been granted bail, he deserves the same benefit.

Accordingly, prayer for bail is allowed.

The petitioner namely Soriful Sk. be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Kalna, Purba Bardhaman subject to the condition that he shall appear before the learned trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

The application for bail is disposed of.
