Petitioner complains of violation of order dated July 19, 2024 passed in M.A.T. 141 of 2013 alongwith connected applications.

By the order dated July 19, 2024, we set aside the decision of the authorities dated May 3, 2012 rejecting the prayer for compassionate appointment of the petitioner. We permitted the authorities to take a decision on the prayer for compassionate appointment afresh after affording reasonable opportunity of hearing the petitioner and to pass a reasoned order and communicate the same to the petitioner.

Materials placed on record suggest that, subsequent to the order dated July 19, 2024, violation of which is complained in this contempt petition, authorities proceeded to consider the application for compassionate appointment and rejected the same.

It is the contention of the petitioner before us that, the rejection was on the basis of the earlier grounds.

With the deepest of respect, the fresh rejection, give rise to cause of action from the petitioner to agitate before an appropriate forum, if so advised. We are not minded to invoke the provision of the Contempt of Courts Act, 1971 or Article 215 of the Constitution of India with regard thereto particularly when the authorities acted on the basis of the order dated July 19, 2024 and passed an order.

We clarify that, issue as to whether the fresh order of rejection is in consonance with any of the directions contained in the order dated July 19, 2024 or in accordance with law are kept open to be decided by the appropriate forum.

C.P.A.N. 1469 of 2025 is disposed of without any order as to costs.
