A direction to secure expeditious disposal of Matrimonial Suit appearing at the evidence stage is the ultimate prayer in this revisional application. In view of the nature of the order proposed to be made, and the status of the pending case, as supported by the photocopy of a document revealing case status of the pending suit, prior notice to the opposite party is considered to be not necessary. Service of notice is thus dispensed with.
Upon perusal of the photocopy of the order dated 1st April, 2021, it appears that the cross-examination of P.W.1 is lying deferred, meaning thereby, the case is at the evidence stage.
Accordingly, learned Additional District Judge, Barrackpore is directed to ensure expeditious disposal of Mat.Suit No.1231 of 2015, pending before the
learned Additional District Judge, at Barrackpore, preferably within a period of eighteen (18) months from the date of communication of this order, but without granting any unnecessary adjournment, unless it is extremely unavoidable.
While endeavouring such exercise, an opportunity of hearing must be ensured to both the parties. Petitioner is directed to make communication of this order to the learned court below as well as to the opposite party and her learned advocate appearing in the court below.
With this direction/observation, the instant revisional application stands disposed of.
Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
