The revisional application was preferred challenging the proceedings of C.R. Case No.16 of 2009 under Sections 498A/34 of the Indian Penal Code pending before the learned Judicial Magistrate, 3rd Court, Sadar, Cooch Behar.
Records of the revisional application reflect that, although the revisional application was admitted in the year 2009, but there was no interim order in respect of the proceedings pending before the learned trial court. The matter again appeared on 14th December, 2016 when also none appeared on behalf of the petitioner.
Today, when the matter is called, none appears on behalf of the petitioner. There is no appraisal made before this Court regarding the present stage of the proceedings. Having regard to the fact I am not inclined to pass any order which touches the root of the prosecution case as the revisional application has become infructuous by lapse of time.
Accordingly, CRR 3259 of 2009 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
