The respondent no. 7 is the wife of the respondent no. 6 and the daughter-in-law of the petitioner. The petitioner claims to have lodged a complaint before the police authorities on June 17, 2023. The petitioner also filed an application before the Sub Divisional Officer, Serampore, DistrictHooghly under the provisions of Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (for short the Act). The learned Advocate appearing for the petitioner submits that the application filed before the Sub Divisional Officer under the 2007 Act is still pending and also that the police authorities have not taken any steps pursuant to the complaint lodged by the petitioner. It appears from the record that pursuant to the complaint lodged by the

petitioner dated June 17, 2023, an F.I.R. being No. 91 of 2023 under Police Station Rishra under Sections 341/323/325/375/506/504/34 of the Indian Penal Code was registered. Since the First Information Report has been registered and the learned Advocate for the State submits that the investigation is in progress, this Court directs the concerned investigating officer to conclude the investigation at the earliest and to take all consequential steps thereupon.

The Sub Divisional Officer, Rishra, being the fourth respondent, is directed to consider the application filed by the petitioner, which is annexed at pages 84 and 85 of the writ petition and to dispose of the same after giving opportunity of hearing to the petitioner and the opposite parties therein, who are the private respondents in this writ petition and by passing a reasoned order. The entire exercise is to be completed by the Sub Divisional Officer within a period of three months from the date of receipt of a server copy of this order along with a copy of the application which is annexed at pages 84 and 85 of the writ petition.

With the above directions and observations, the writ petition stands disposed of.

There shall, however, be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
