22.08.2023 sdas rejected C.R.M.(DB) No. 3278 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Bhimpur Police Station Case No. 80 of 2023 dated 16.03.2023 under Sections 489B and 489C of the Indian Penal Code.

And In Re : Manick Biswas @ Manik .... petitioner Ms. Roma Roy ....for the petitioner Mr. Binay Panda Ms. Puspita Saha ...... for the State 1.Learned Counsel for the petitioner submits alleged FICNs had been planted and he has been falsely implicated. He prays for bail.

2. Learned Counsel for the State opposes the prayer for bail and submits FICNs valued at Rs.15,000/- were recovered from the petitioner.

3. We have considered the materials on record. Initially a large volume of FICNs were recovered from the co-accused. In the course of investigation petitioner was arrested and FICNs valued at Rs.15,000/- were recovered. No FICN was recovered from the coaccused who is on bail. Petitioner cannot claim parity with the said co-accused. In view of the prima facie materials on record and considering the possibility of similar offence occurring in future if

the petitioner is released on bail we are not inclined to grant bail to him.
